The Nepal Bar Association (NBA) today submitted suggestions on the draft of the new constitution to the Constituent Assembly (CA) chairman Subash Nembang.
The NBA met the CA chairman at his office in Singha Durbar to hand over the suggestions. Among others, lawayers have suggested making provision of 21 judges in the Supreme Court and removing temporary judges. The preliminary draft has made provision for 15 justices in the Supreme Court including the Chief Justice.
Likewise, the NBA has suggested replacing the provision which requires a senior advocate or an advocate should have practised law for 15 years to qualify appointment as Justice in the Supreme Court with 20 years. It also proposes to do away with the provision which states that an official working in the Law Service in a post of Gazetted First Class or above could be directly appointed as the justice of the Supreme Court.
The lawayers' association has also suggested keeping a separate five-member permanent constitutional bench in the Supreme Court, instead of the draft provision of 10-member Constitutional Court.
CA chairman Nembang gave assurances that he would make best efforts to incorporate the issues missing in the proposed draft, NBA General Secretary Pokhrel said. RSS
